Listing Description
As a Seller, you are OBLIGATED TO THE FOLLOWING SALE CONDITIONS.
1. You must be legally able to sell the livestock lots you list for sale on
this site.
2. You must describe your lots and all terms of sale on the listing page of this site.
3. Your listings may only include text descriptions, graphics, pictures and other content relevant to the sale of the lot(s) you are listing.
4. Neither you, nor any representative for you or associated with you, may manipulate the price of any lot, nor may you interfere with other user's listings or transactions in relation to this site.
5. Definition. "Your Information" is defined as any information you provide to us on site or to users of said site in the registration, bidding or listing process. You are solely responsible for "Your Information", and we act only as a passive conduit for your online distribution and publication of "Your Information".
6. Restricted Activities. "Your Information" (and any lot listed) and your activities on this site SHALL NOT: a) be false, inaccurate or misleading; b) be fraudulent or involve the sale of counterfeit or stolen lots; c) infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; d) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition,
anti-discrimination or false advertising); e) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing.

Seller Representations and Warranties.
As a Seller, you warrant and make the following representations.
1. Fraud. Without limiting any other remedies, DLBe-auctions may suspend or
terminate your account immediately if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with our site.
2. Health and Export. All cattle selling will have a proper health certificate. Cattle purchased for shipment to states other than state of origin shall be at the risk of the Buyer and it is the Buyers responsibility to meet all health requirement for entry into said state, or other country.
3. Seller's Risk. Seller retains all risk to loss of animal prior to it being sold. Upon being declared sold, Buyer assumes all risk of loss thereafter.
4. Changes. Announcements of changes or corrections made at sale site or on
final sale day will take precedence over any and all printed materials.
5. Health and Export. All cattle selling will have a proper health certificate. Cattle purchased for shipment to states other than state of origin shall be at the risk of the Buyer and it is the Buyers responsibility to meet all health requirement for entry into said state, or other country.
6. Registrations. Any registered animals will be noted, and sells with proper registration certificate, complete and signed by Seller at Seller's expense. Inquire about specific sale registration availability. Transfer costs will be paid by Seller(s), unless stated otherwise.
7. Association Terms. Breeding cattle sell under the additional Terms and Conditions of the particular recognized United States breed association, pertaining to the breed being sold. On breeding livestock, please inquire as to standard breeding guarantees, warranties, and any exceptions. Successful Buyer's will be supplied with any applicable guarantees, etc. with purchase invoice.

Membership Eligibility.
You agree to meet the following requirements to be a member on this web site.
1. The services offered on this site are available only to individuals who can form legally binding contracts under applicable laws.
2. Without limiting the foregoing, our services are not available to minors, or to temporarily or indefinitely suspended DLBe-auctions.com members. If you are a minor, you can only use the services of this site in conjunction with your parent(s) or guardians.
3. Your site account, and feedback) and User ID may not be transferred, loaned or sold to any other party. 4. If you register as a business entity, you represent that you have the authority to bind said entity to this Agreement in it's entirety. Liability Disclaimer.
The following pertains to Buyer(s) or Seller(s) in relation to site owners, managers, partners, suppliers and others working with the creation of this site.
1. The information contained on this site was given to site personnel by Seller(s). All activities performed by site personnel is done as a service - therefore, sitepersonnel assumes no liability for the accuracy of information contained herein or for any representation of Seller(s).
2. All person's who bid or buy any lot on this site do so at their own risk. Site personnel assume no responsibility for the failure of either Seller(s) or Buyer(s).
3. By bidding or buying at any auction on site, Each Buyer and each Seller agrees to indemnify, defend, and hold harmless the site owners, their respective offices, managers, partners, suppliers and any others working with this site. All site personnel are held harmless of all claims, liabilities, damages and all costs arising out of/or related to any site auction or sale event.
